Reading between the lines (the airlines already have), this regulation is worthless on it's face because it does not direct airports to keep a gate or two open for a delayed flight to return to. All the airports that have this tarmac-delay problem also have a gate-availability problem.
In case you haven't noticed, most international and regional airports in this country don't allow passenger embarking/debarking on the tarmac (security rules), but only through concourse jetways. What this reg means is that if the airport says, "so sorry, no gate available", the no-stranding rule is then waived, and the pax are still stuck aboard.
The bugsmasher regionals that use the General Aviation terminals at large airports will always have a place to return their aircraft to, but generally, they aren't the ones stuck waiting for departure.
Another Obamanation, much hoopla, but little hope of solving the problem.
