Immigration is the purview of Congress, not the Executive, and that will come out in court, at which time the President will lose this round.
He's made a giant mistake here, but he made it out of desperation. He simply HAD to try to get the voters' minds off of the terrible economy, so he led with his chin. The GOP will knock him out of the ring.
It's ironic, but he could have achieved the same results legally.
Here's what he needed to do.
The power the President possesses legally here is the power of the pardon. He should have announced that every one of these illegals, all of whom have committed felonies by entering the country illegally, will be pardoned if they follow the rules of the so-called "dream act" that Obama put into place by fiat two days ago. Thenh, all Obama had to do was set up the process to acomplish that, and it's done, and done legally. As it stands under current law, these young illegals can never become naturalized citizens anyway, because they will all have a criminal record. Pardons MUST be issued in order to make them citizens. They can't be swept in on any amnesty act because no act can become law if it is "ex post facto".
There's no doubt in my mind that the President lacks the Constitutional authority to do what he just did, but he can rest assured that it probably won't be adjudicated before the election, so what does he care?
Instead of shouting "BACK DOOR AMNESTY" at the top of our voices, we should be shouting "DUMMY DID IT WRONG" .
This stupidity reveals on other thing: Obama is no Constitutional scholar, so it follows that he got his Juris Doctor by "social promotion".
Yada yada yada! Yep, those wicked 2 year olds, committing felonies left and right. Toss 'em on their ears! Do you think they all escaped from Mexican jails and enrolled in US high schools? Some fairly significant percent of the target population are from EUROPE!
